An arrest has been made in connection with a fatal accident in the Orleans County Town of Gaines.

18-year-old Mitchell Kirby of Albion has been charged with Vehicular Manslaughter and Operating a Motor Vehicle While Impaired by Drugs. Kirby was arrested this morning by the Orleans County Sheriff’s Office following an investigation into the May 20th crash that killed 65-year-old Victor Wilston of Albion.

Wilston was pulling out into Zig Zag Road from a private driveway when his vehicle was struck by a pick-up truck driven by Kirby.

At the time of the accident, investigators said excessive speed on Kirby’s part was a factor in the crash.

Kirby was arraigned on the charges in Town of Gaines Court and released on his own recognizance.

Individuals need to pay attention to what they are doing while driving. I see too many people talking on phones, playing with the radio or speeding. If you're going to drive, pay attention to the roads and the other drivers.
