Batavia Police report Wednesday afternoon that 13-year-old Michael Smith, who had been missing since Monday, has been found safe in Cleveland, Ohio.
Smith has been detained, along with his mother who does not have legal custody of the boy. Smith's father, also from Batavia, is currently on his way to Ohio to pick up Michael.
Batavia Police say Michael Smith was last seen Monday near a motel where his mother was staying. The two were apparently reported getting on a bus near Buffalo, or headed to Buffalo. They turned up today in Cleveland.
Batavia Police Detective Todd Crossett tells WBTA News this does not appear to be a case of kidnapping. He says all indications point to the 13-year-old getting on the bus of his own will. Crossett says if any charges are placed, they will likely involve a violation of custody.
