A Wyoming County woman is facing multiple felony charges for allegedly driving drunk while her three children were in the car.
31-year-old Kelly Ann Holderer of 11 East Genesee Street, Perry, is charged under New York State's Leandra’s law, making it a felony to drive drunk with children in the car.
A Genesee County sheriff’s deputy first noticed Holderer’s car leaving the LeRoy area heading for Perry early this morning.
Once inside Wyoming County a deputy observed Holderer's car crossing the centerline of the highway three times, according to the sheriff's office.
Holderer’s car was stopped and deputies found her three children, ages five, seven and ten, were inside the vehicle.
The children were turned over to a family friend. Wyoming County Child Protective Services will be assisting int he investigation, deputies said.
Kelly Holderer was given a breath test and registered a BAC of .21-percent. The legal limit is .08-percent.
Holderer has been charged with Felony Driving While Intoxicated, Felony Aggravated Driving While Intoxicated and three felony counts of "Leandra's Law," felony DWI with a child int he vehicle. Ayoming County Sheriff's Office captain said Holderer had a previous DWI conviction on her record.
Holderer has been jailed on $10,000 bail.
