Governor Andrew Cuomo's casino plan for New York State may exclude Western New York.
Cuomo said Thursday that his plan to build three private casinos upstate would go forward under the idea that the state would work to not infringe on existing gambling pacts that are in "good standing."
A spokesperson for Batavia Downs Casino declined further comment and says it is taking a wait-and-see approach on the Governor’s proposals.
In his State of the State address, Cuomo announced plans for three Upstate casinos to draw New York City residents to the region instead of going to New Jersey or Connecticut.
Batavia Downs collected 45-million dollars in video gaming revenue in 2012 with half of that going to the state.
