A 19-year-old Batavia man who was allegedly caught in the act of a burglary on Washington Avenue Jan. 2 has been indicted on a felony charge of second-degree burglary and criminal mischief.

Francis Smith of 20 South Main Street, the report states, entered the home without permission and damaged a window and a screen in the process.

An alert neighbor notified police of a potential burglary in process which lead to Smith’s arrest. He was sent to county jail on $25,000 bail. Batavia Police at the time were investigating Smith’s possible involvement with other larcenies in the city.
