A Batavia man is facing a felony count of drunk driving.
62-year-old David Maxwell of Vine Street was stopped for allegedly failing to dim his lights to oncoming traffic on Route 33 in Pembroke Wednesday. Maxwell allegedly led law enforcement on a brief pursuit before he was stopped in the Town of Batavia.
Deputies charged him with felony DWI and five other violations including Refusal to Take a Breath Test and Controlled Substance not in its Original Container.
Maxwell is due in court August 6.
A Lima man is accused of choking his girlfriend in the Town of Perry early this morning.
28-year-old James Dersam is charged with Criminal Obstruction of Breathing. Under New York’s domestic violence laws, he is additionally charged with Aggravated Family Offense – a class E Felony – for a 2011 conviction for Attempted Assault.
Dersam was jailed on $15,000 bail and scheduled back in court July 17.
