The Canadian man accused of beating an Alden native at a Darien Lake Concert July 5 is indicted on a felony assault charge.

The victim, Jason McNeil is still hospitalized in Western New York, according to a Facebook page set up by his wife to update his status. He suffered a severe head injury because of the incident.

Craig Lawson, 34, of Courtland, Ontario is indicted on a second-degree assault charge. He made $1,000 bail after he was arrested and went back to Canada. Lawson was initially charged with a misdemeanor assault count.

McNeill lives in Tuscaloosa, Ala. with his wife and young children.

Lawson is due in Genesee County court Sept. 3; he will be represented by state senator Michael Ranzenhofer.
