Two races from Tuesday’s elections have yet to be decided.
Just three votes separate Michael Welsh and Scott McCumiskey for LeRoy Town Justice.
Republican Election Commissioner Richard Seibert says absentee ballots from the LeRoy race wikll be counted on Tuesday because it is the closest election. 
In the District 9 legislature race, 21 votes separated Ed DeJaniero and Bob Bialkowski…DeJanerio, the incumbent, had the lead.Seibert said absentgees in District 9 will be counted next.

The husband of Monroe County Executive Maggie Brooks is one of four people facing bid-rigging charges.  Charged in the case is Brooks' husband Robert Wiesner and three other men.
The four are accused of conspiring to steer lucrative county contracts to connected companies in exchange for cash.

Governor Andrew Cuomo says construction of new casinos resulting from the passage of Proposition One will bring thousands of jobs to the state and over $400-million in new tax revenue.  
The referendum approved by voters Tuesday will permit the construction of seven Las Vegas-style casinos around the state but not in Western New York.

51-year-old Sharon Herdtner of North St., Batavia:
She’s been arrested for failing to appear before the Grand Jury

45-year-old Philip DeGraff of Perry:
He was arrested by Batavia Police for allegedly threatening to kill an acquaintance. DeGraff was jailed in lieu of $1,000 bail.

18 year-old Winston Lockhart of Lewis Place, Batavia:
He was ticketed for…littering.
Police say Lockhart tossed a lit cigarette onto the road in front of two police officers.
They asked him to pick it up and dispose of it properly.
He did not, police said.
