An Erie County man is charged with Hunting While Intoxicated after he allegedly pointed a gun at someone on their property.

Wyoming County Sheriff’s deputies responded to a call on Holland Road in the Town of Java this weekend where complainants said they confronted a man for hunting on their property who then pointed a gun at them.

John Smith, 44, of Sardinia, Erie County, is also charged with second-degree menacing. His blood alcohol content was found by a breath test to be more than three times the legal limit, according to the sheriff's department report.

Smith is due in court Dec. 18.
