The trial for a Batavia man accused of assault on Harvester Avenue is now in the hands of the jury.
Both the prosecution and defense presented their sides and jurors heard testimony for both.
Shane Bell, 47, is accused of striking 51-year-old Scott Baker outside of the Harvester Bar last August.
Bell does not deny throwing a punch with his off-hand that left Baker in a coma for weeks. He’s now confined him to a nursing home fed by a tube.
In a videotaped statement to police at the time of his arrest Bell said he did not mean to cause serious damage to Baker.
With the second-degree assault charge on Bell, the jury will have to determine if Bell intended to seriously harm Baker.
