The part-time Perry police officer accused of killing his own son when he said he mistook him for an intruder agrees to a plea deal.

Michael Leach – also a retired Rochester Police Captain – pleaded guilty to criminally negligent homicide today in Herkimer County Court.

He had been indicted on a second-degree murder charge for fatally shooting his son, 37-year-old Matthew Leach, at around 1 a.m. in July 2012. The two were in Old Forge, New York for an annual trip with a motorcycle club.

Leach was set to go to trial this month after he rejected a guilty plea to a second-degree manslaughter charge last year.

Leach will be sentenced in August.
