Two Genesee County men are facing DWI charges after a two-ATV accident in Pembroke last weekend.

The reported drivers, 26-year-old Charles Chatley of Kilian Road, Corfu and 35-year-old Stephen Smelski of West Main Street, Batavia are also charged with unlawful operation of an ATV on a public highway.

The accident was reported last Sunday on Route 5 in the Town of Pembroke. The two ATVs each carrying a passenger were riding in a lane going the same direction when they collided and the riders were ejected, deputies said.

Both passengers, 26-year-old Kristina Rumble and 37-year-old Brenda Smelski, were treated and released at ECMC.

Stephen Smelski is an East Pembroke Fire Department 1st assistant chief and Genesee County emergency dispatcher. Chatley is a 2nd assistant chief with East Pembroke.

Smelski has been hospitalized the longest of the four involved in the accident. He is listed in good condition Monday afternoon at ECMC. He was additionally charged with leaving the scene of a personal injury accident.
