Hold the re-fried beans…Margarita’s Restaurant on Jackson Street in Batavia has been shutdown by the state for non-payment of nearly $33,000 in taxes.
State agents moved in on the eatery right at the lunch hour yesterday, ushered the diners out and padlocked the door.

A Batavia man has been stabbed in the back during a fight in Pike.
25-year-old Josh Sumeriski of Pringle Avenue suffered a superficial wound.
The other half of the fracas, 20-year-old James Lathrop of Warsaw, was arrested for assault. Lathrop cut a finger and injured his eye in the fight. Both men were treated at Wyoming County Community Hospital.
A Livingston County woman accused of murdering her boyfriend with a pair of scissors has been indicted on a lesser charge. A grand jury handed up an indictment against 20-year-old Krista Kiblin of Nunda on a felony count of criminally negligent homicide instead of the original murder charge. Authorities say Kiblin stabbed 18-year-old Joseph Garcia of Arkport in the chest during a domestic dispute in Nunda earlier this summer. Kiblin now could get up to four years behind bars if convicted. She had been facing 25 years to life.

An Oakfield woman is charged with Drunk Driving in Bergen.
Sheriff’s Deputies say 34-year-old Deanna Virgo of Garibaldi Avenue, Oakfield, was arrested last night at the Bergen Service Center.
Witnesses told deputies that Virgo was seen earlier at the Bergen Sugar Creek, apparently intoxicated, and without her pants on.
A tea party in Alexander?
17-year-old Joel Zajaczkowski of Alexander is charged with Petit Larceny.
Deputies tell us Zajaczkowski took a case of Arizona Iced Tea that fell off a delivery truck at the Alexander Country Deli.
