It will be one and a half years to three years in jail for 39-year-old Cain Catino of the Seven Spring Road in Batavia. He will also receive comprehensive Alcohol and Substance Abuse Treatment. Catino learned sentence this morning from County Court Judge Robert Noonan following a plea agreement. Catino had entered a guilty plea in connection with the hold-up of the Oakfield Family Pharmacy back in September,
Catino entered through the rear door of the Pharmacy shortly after noon and walked behind the counter. He demanded Oxycodone, a prescription painkiller. State Troopers said Catino then reached into his pocket as if going for a weapon. That’s when Pharmacist Joe Miles and another store employee took him down. Catino pled guilty to Attempted Robbery.
In an aside to the story, Catino’s mother, 60 year old Kathleen Catino was accused of smuggling drugs to her son while he was in the Genesee County Jail. She also entered a guilty plea. She will avoid jail time if she stays out of trouble until her sentencing in January. Kathleen Catino was originally charged with possession and sale of drugs and promoting prison contraband.
